Will the entrepreneur be paid for the products supplied?

Recently, cases of delays in contractual payments under contracts between entrepreneurs and government bodies have become more frequent. All this leads to appeals to government agencies in order to collect overdue receivables from entrepreneurs.

Untimely measures of entrepreneurs to collect debts can cause consequences for bringing to liability the management and the chief accountant in accordance with the law. At the same time, late payment for products supplied by an entrepreneur leads to delays in production, expansion of business activity and payment of monthly wages to employees of business entities. However, the state body that received the entrepreneur's goods does not think about such consequences.

Moreover, in society, there is a disdainful attitude towards entrepreneurs who try to defend their rights and legitimate interests.

In accordance with the Law "On contracting and legal basis of activity of business entities", disputes arising between the parties during the conclusion, execution, amendment and termination of business contracts, as well as compensation for damages are considered in the manner prescribed by law by the economic court.

This, in turn, leads to the payment of state duties and postal services from the account of the government agency in addition to the payment of receivables.

As an example, the Business Ombudsman studied the appeal of IE "Ibragimov Sardor Anvarovich" about non-payment of debt in the amount of 758 million soums for products supplied to the improvement department at the khokimiyat of the city of Bukhara.

When considering the documents on this appeal, it was established that the entrepreneur was not paid the amount for the products delivered in accordance with the terms of the contract, which in turn damaged the interests of the entrepreneur.

Despite the fact that the supplier presented a claim to the debtor to pay the debt, the debt was not paid.

In this case, in the interests of the entrepreneur, the Business Ombudsman filed a lawsuit with the economic court to recover the debt from the improvement department at the khokimiyat of the city of Bukhara. This statement of claim was considered by the economic court and the claim of the Business Ombudsman was fully satisfied. As a result, a decision was made to collect the debt from the management of improvement at the khokimiyat of the city of Bukhara.
